Is it possible to negotiate the removal of the disputed paragraph with Imperavi?
The price is currently very interesting, and a WYSIWYG editor quality is a plus for our customers and Textpattern.

I guess everything’s possible. Whether they’d be willing to grant us a less-restrictive licence without those two clauses (at minimum) is up to them and what they’d benefit from allowing us to integrate it into Txp.
Judging by the number of typos and grammatical errors in the licence, I suspect either non-native English speakers or lack of attention to detail (I doubt it’s been drafted by a lawyer). If the former, discussions might be better in the native language, with information fed back to our community in English, so there’s less chance of nasty surprises if they do make special amendments to the licence for us.
Either way, this clause:
Imperavi LLC reserves the right to alter this agreement at any time, for any reason, without notice.
fills me with dread. Although it’s standard lawyer-speak, the fact they could pull the rug from under us at any moment — even with a special agreement in place — doesn’t help our client base if things go south between Imperavi and us.
EDIT: imagine it’s rolled into v4.7 and at a later stage the agreement breaks down. Would that mean all users of Txp 4.7 are violating the licence? The download is always available from our site, with Redactor built in. It has to be: it’s open source. What about those users who cant / won’t upgrade because their customers rely on it and who won’t necessarily wish to buy their own licence to continue usage? Sticky icky.

Forgive any unintended ignorance — what barriers are there currently that prevents a GPLv2-friendly wysiwyg editor from being added to a Textpattern instance?

None whatsoever. I favour markItUp with a suitable WYSIWYG toolbar. Like Jukka did with rah_textile_bar.

Ryan Cramer from ProcessWire tried this in 2012:
They say they “allow” it, but the problem is the GNU license doesn’t. He didn’t say anything to indicate an understanding of the GNU license. The liability falls on to the developer that’s integrating with GNU software.
Ryan’s post is four years old, but as we face the same situation now I think this indicates a general direction of Imperavi’s business goals and non-goals. I am hesitant to take Imperavi’s recurring changes in their default license terms and prices as a positive sign.
