Hmm, can you add it as first node in the <footer ? And leave in a static position.

Also, perhaps it could be a bit more visible, the .warning class sounds more appropriate to me.

What hidalgo suggest: rvm_maintenance. Works great, and friendly to search engines. I use it every time I do a major Textpattern update.
